1. Acceptance of Terms
By creating an account or using WorkPulse ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these terms.
2. Description of Service
WorkPulse is a web-based time tracking, invoicing, and contractor management application. The Service is provided at your chosen subdomain (e.g., yourcompany.acarr.org) and includes features for managing clients, projects, contractors, time entries, invoices, expenses, and pay periods.
3. Free Trial
- New accounts receive a 30-day free trial with full access to all features.
- No credit card is required to start a trial.
- At the end of the trial period, your instance will be suspended. Your data will be retained for 30 additional days.
- If you do not subscribe within 30 days of trial expiration, your data will be permanently deleted.
- We may modify or discontinue the free trial at any time.
4. Account Registration
- You must provide accurate and complete information during registration, including a valid email address and phone number.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately of any unauthorized access to your account.
- One trial account per company. Duplicate signups to extend trials may result in account termination.
5. Your Data
- You retain ownership of all data you enter into WorkPulse.
- We will not access, use, or share your data except as necessary to provide the Service or as described in our Privacy Policy.
- Each customer's data is stored in a dedicated, isolated database.
- You are responsible for maintaining your own backups of critical business data. While we perform regular backups, we do not guarantee data recovery in all circumstances.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to access another customer's data or systems.
- Interfere with or disrupt the Service or its infrastructure.
- Use automated tools to scrape, crawl, or overload the Service.
- Resell or redistribute the Service without written permission.
- Upload malicious content or attempt to exploit security vulnerabilities.
7. SMS and Email Communications
- By providing your phone number and consenting during signup, you agree to receive transactional SMS messages including verification codes and business notifications.
- Message and data rates may apply. Messaging frequency varies based on your activity.
- You may opt out of SMS notifications at any time through your account settings or by replying STOP.

8. Service Availability
- We strive to maintain high availability but do not guarantee uninterrupted access.
- We may perform maintenance that temporarily affects availability, with reasonable notice when possible.
- The Service is provided on shared infrastructure during the trial period. Performance may vary.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim (which is $0 during the free trial).
- We are not responsible for losses resulting from data entry errors, system outages, or third-party service failures.
10. Termination
- You may cancel your account at any time by contacting us.
- We may suspend or terminate your account for violation of these terms, with notice when practical.
- Upon termination, your data will be retained for 30 days and then permanently deleted.
11. Changes to Terms
We may update these terms from time to time. We will notify you of material changes by email or through the application. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law provisions.
